Fabricore Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fabricore (the "Service"), including all software, templates, generated geometry, models, drawings, toolpaths, exports, and related functionality.

By creating an account or using the Service, you agree to these Terms.

1. Definitions

Fabricore is operated by an individual owner under the trade name "Fabricore."

Fabricore: The individual owner operating under the trade name "Fabricore."

Service: The Fabricore platform, including software, APIs, templates, and related systems.

User: Any individual or entity accessing or using the Service.

Account Holder: A User who has registered an account.

Output: Any file or data generated by the Service, including CAD, CAM, STEP, STL, DXF, drawings, or toolpaths.

User Input: Any data, parameters, or instructions submitted by a User.

Terms: These Terms of Service.

2. Acceptance of Terms

Access to or use of the Service constitutes acceptance of these Terms by the User.

3. Nature of Service

The Service is a software tool for parametric design generation.

Fabricore is not:

an engineer of record
a manufacturer
a quality assurance provider
a regulatory or compliance advisor

All Output usage responsibility remains with the User.

4. Eligibility

Use of the Service is permitted only if:

the User has legal capacity to enter a binding agreement
use complies with applicable law

Use on behalf of an entity constitutes representation that the User has authority to bind that entity.

5. Ownership and License

5.1 Fabricore Ownership

Fabricore retains all rights in:

the Service
software and infrastructure
templates and system logic

5.2 User Ownership

The User retains rights to:

User Input submitted by that User
Output generated from that User Input

5.3 License

The User is granted a:

limited
non-exclusive
non-transferable
revocable license

to use the Service in accordance with these Terms.

6. Permitted Use of Output

Output may be used for:

commercial purposes
manufacturing
distribution to vendors or contractors
internal or external business operations

7. Restrictions

The User may not:

resell or sublicense the Service
replicate templates or system logic
reverse engineer internal functionality
build competing systems using the Service
use unauthorized automation or scraping
train machine learning models on Service outputs at scale

8. No Guarantees

Fabricore provides no guarantees regarding:

accuracy
manufacturability
safety
regulatory compliance

9. User Responsibilities

The User is solely responsible for:

verifying geometry and dimensions
validating manufacturability
testing and inspection
legal and regulatory compliance
intellectual property clearance
safety measures

10. Prohibited Applications

The Service or Output may not be used in:

medical or life-support systems
aviation or flight-critical systems
nuclear systems
weapons or targeting systems
automotive safety systems

unless explicitly approved by Fabricore in writing.

11. Assumption of Risk

All risks arising from use of the Service or Output are assumed by the User.

12. Disclaimer of Warranties

The Service and Output are provided:

"AS IS"
"WITH ALL FAULTS"
"AS AVAILABLE"

13. Limitation of Liability

Fabricore shall not be liable for:

indirect or consequential damages
loss of profit, data, or business

Maximum liability is limited to the greater of:

fees paid in the prior 3 months
$50 USD

14. Indemnification

The User agrees to indemnify Fabricore against claims arising from:

use of the Service
Output
manufactured products
legal violations

15. Payment Terms

For paid Services:

fees are billed in advance
subscriptions renew automatically on a per-seat basis
cancellation applies at period end
fees are non-refundable unless required by law

16. Suspension and Termination

Fabricore may suspend or terminate access if a User:

violates these Terms
creates legal or safety risk
misuses the Service

17. Data Handling

Fabricore may process:

User Input
Output
usage data

for operation and improvement of the Service.

18. Export Compliance

Compliance with applicable export laws is required.

19. Modifications

Fabricore may update these Terms at any time.

20. Governing Law

These Terms are governed by California law.

21. Severability

Invalid provisions do not affect remaining Terms.

22. Entire Agreement

These Terms constitute the complete agreement regarding the Service.
